PLEASE READ THESE TERMS CAREFULLY.  Please note that the Gaia House service is an entirely separate service and using it is subject to this specific term of use and a separate privacy policy.

 

These services are run by Gaia House (referred to below as “we”, “us” or “our”).  Gaia House is registered business in Germany with registered office at Am Jägerhof 7, 37235 Hessisch Lichtenau, Germany.

 

These “Terms of Use” (together with the documents referred to in them) tell you the terms of use on which you may make use of our website http://www.gaiaretreathouse.com/ (the “Website”), whether as a guest or website visitor. Use of our service includes accessing, browsing, searching, booking, reservation, using our forums or registering to use the Website.

 

We may update these Terms of Use from time to time, including, to reflect changes in law or as a result of changes to the content of the Website or the addition of new features – it is therefore imperative that you refer to these Terms of Use from time to time to ensure that you are familiar with the relevant terms which will govern your use of the Website. This version of the Terms of Use is effective as from December, 2019.

 

By using our service, you confirm that you accept these Terms of Use and that you agree to comply with them. If you do not agree to these Terms of Use, you must not use our Website.  Subject to any specific terms identified in respect of a particular feature or part of our service, these Terms of Use (including, our Privacy Policy) constitute the entire agreement between you and us with respect to your use of the service and Gaia House features.

 

YOUR USE OF THE WEBSITE

We do not promise that our Website, or any content on it, will always be available or be uninterrupted. Access to our Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Website without notice to you. We will not be liable to you if for any reason our Website is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to access our Website (including, having access to an internet connection and an appropriate browser).

You are also responsible for ensuring that everyone who accesses our Website through your internet connection is aware of these Terms of Use and other applicable terms and conditions, and that they comply with them.

 

RESERVATIONS & BOOKINGS

By completing the online reservation or by placing your reservation over the telephone or verbally by Face-time / Skype / Whatsapp / Facebook communication you accept these Terms and Conditions as a binding agreement between GAIA HOUSE and yourself and other members that are part of your booking. A written/emailed confirmation sent by GAIA HOUSE confirms your reservation. Booking is only valid after full payment or a deposit payment was made.

 

CHANGES TO BOOKING AND ACCOMMODATION

GAIA HOUSE reserves the right to modify the booking dates due to several reasons, not limited to but including war, pandemic, hostile weather conditions, or matters concerning safety, operational circumstances such as damage caused by fire, or the accommodation becoming unusable due to utility company work or lack of services, leaks, repair work or any other such reason. In these occurrences, the booking may need to be adjusted accordingly.

 

If you cannot accept the dates of the new booking that GAIA HOUSE propose, your payment will turn into a stored credit and you will get a one year voucher to re-schedule your arrival. The Voucher can be handed/sold to another person at your choice, and will be respected by us.

 

GAIA HOUSE will not be liable for any additional costs or losses that may occur to you due to the change of booking. This includes, but is not limited to, any extra hotel reservations, car rentals or the cost of non-refundable airline tickets.

 

PAYMENT AND DEPOSIT

 

For Individual Bookings: To secure your booking, full payment is required upon your reservation. 20% of your payment will be considered as non-refundable deposit in case of cancellation according to our cancellation policy written in the cancellation paragraph below in these Terms & Conditions.

 

For Group Booking: A non-refundable deposit of €250 is required online or bank transfer upon your reservation to guarantee your dates. The remaining balance to be paid fully up to 90 days before the reserved dates.

 

USAGE WITH EXTRA FEES

The usage of the sauna, laundry room and espresso machine are at extra fees according to the prices and terms shown on our website. For Individual Bookings, breakfast is available as an option with an extra fee.

 

TRANSACTIONS

We accept VISA, Master Card, Paypal, Direct Deposit or Cash. Payment is due at the time of booking. Alternatively a “Request for Accommodations” form must be completed.  We don’t take or keep any credit card or financial information to secure any further payments.

 

AUTHORIZED PAYMENTS ARE FINAL

Your use of the Gaia House 3rd party Billing and Payment Services constitutes your agreement to pay for any amounts which you authorize us to retain from transactions and, as appropriate, charge to your credit card, bank account, or PayPal account. Such payments, once authorized, are final.

 

Please note: We use 3rd party billing and payment services, we will not be responsible for them in the event of failure. When an Acceptance of Services has occurred, (i) Gaia House shall have no further liability to any party with respect to Payment for such services, (ii) user acknowledges that Gaia House has provided a complete service in respect of the payment made for the Assumed Payment Liability or Invoice, as applicable and (iii) customer hereby releases Gaia House from any and all liability with respect to such Payment.

 

CANCELATIONS/REFUNDS

Gaia House requires a full 28 days notice, prior to check-in date, for any cancellation of standard bookings. Customized stays, including full property bookings or retreat packages, have a separate booking policy. Inquire with management for details during the planning process.

 

For Individual Booking:

Cancellation notification less than 60 days before the date of arrival: full refund minus 20% registration fee. Cancellation notification less than 45 days prior to arrival: 50% refund. Cancellation notification less than 30 days before the date of arrival or no-show: no refund.

In the event of any forced lockdowns/regulations that will cause cancelations of our Retreats, your payment will turn into a stored credit and you will get a one year voucher to re-schedule your arrival.

 

For Group Booking: For any cancellations made after an agreement is signed, the €250 deposit is non-refundable. For any cancellations made less than 90 days before your booking date, 50% of your booking fee will be non-refundable. For any cancellations made less than 30 days before your booking date, 100% of your booking fee will be non-refundable.

 

In both cases, to cover any such uncommon cancellation incidence, it is therefore, strongly recommended, that you’ll have a travel insurance with a cancellation policy.

 

REGISTRATION/EMAIL/PHONE NUMBER

To access our Services through our Website, you must be a legal entity, or an individual of eighteen (18) years of age or older who can form legally binding contracts.

 

In order to book or make reservations, You agree to provide true, accurate and complete information as prompted by the registration form and all forms you access on the Website, and to update this information to maintain its truthfulness, accuracy and completeness.

 

During the booking process, you will be asked to provide a valid email, phone number. It is important that you supply us with a valid email address. If you change it after your booking or reservation, please inform us instantly since once your booking has been made and we have received your payment or deposit, all further correspondence will be by email. You will also get an email from us with all the information that you need how to get to GAIA HOUSE location.

 

CHECK-IN

Check-in time is at 14:00. In the event that you intent to check in earlier, or later please pre-arranged and approve it with our management office. If you plan to come later than 18:00, please endeavor to inform us by email or telephone.

 

CHECK-OUT

Check-out from Gaia House no later than 12.00. In the event that you require a late check-out from the room it has to be arranged with the Gaia House management office in advance.

 

TOUR INSURANCE

To prevent any discomfort from uncommon cancellation incidence, it is strongly recommended, that you’ll have a travel insurance, including medical cover for medical treatment, accidents and repatriation, holiday cancellation and curtailment. We undertake that such a policy is in control before your departure.

 

ARRIVAL DELAYED/CANCELLED

If your arrival is delayed or cancelled, it is essential to inform either the group leader or GAIA HOUSE management. Please make sure to carry with you both numbers and emails.

 

OUR RESPONSIBILITY

We are responsible for providing the services listed and confirmed at the booking confirmation, where it is within our control. Furthermore, it is agreed by you that the owners/operators of the retreat/seminar are not the guardians of any customers’ safety and they, individually or collectively, cannot be held liable in any way for occurrence which might result in illness, injury or other damage, loss or theft to the customer, his property, or his family, heirs or assigns. The liability of GAIA HOUSE is limited to a total of the booking price irrespective of the title/claim.

 

PARKING

Parking in Gaia House is free. Please use only our parking space in front of the house. You are kindly requested not to park in any other place around. If the parking space is full, please contact us and we will guide you where to park.

 

WIFI

WiFi at Gaia House is free and available in most of the house space. Still, from time to time because of the provider infrastructure there are fluctuations of service. Gaia House is not held responsible in cases of service interruptions.

 

FOOD AND BEVERAGE

Gaia House have a certified vegetarian kitchen. Individuals or groups that are using the kitchen by themselves are compulsorily asked not to cook any meat in the house kitchen or elsewhere in the house area. Furthermore, Gaia House is not allowed to sale any alcoholic beverage to her guests.

 

SAFETY & HYGIENIC RULES

GAIA HOUSE is a wooden house located in a natural forest surroundings. To keep the house safe & hygiene during your stay, you are asked to respect these following rules:

  • Smoking is not allowed anywhere in the house.

  • The usage of any drug is not allowed.

  • Candle-lighting is not allowed anywhere in the house.

  • All exterior doors must stay closed always to avoid any animals to come in.

  • Plates, glasses food or any other kitchenware should not be taken to the rooms.

  • Any food remains are thrown only in the kitchen garbage.

  • Tampons & bandages shouldn’t be thrown to the toilet.

 

BEHAVIOR ON STAY

We have put great effort to renovate and maintain GAIA HOUSE to the best of our guest’s comfortability, you are kindly asked to help us keeping the house usage it it’s actual conditions:

  • Treat the house property as yours.

  • Leave your shoes at the entrance of the house.

  • Keep your room door closed while the heating is on.

  • While refreshing your room and opening the window, please close the heating system.

  • Keep the house clean during your stay.

  • If you become sick, please stay in your room.

  • Upon your leaving take off your beddings and place them on your bed along with your towels on the bed.

  • Kitchen usage is vegetarian only.

  • Music in the seminar room is allowed until 23:00 only

 

PETS

Pets are not allowed at Gaia House.  This is because, it is desired to be an allergic friendly house, therefore, no kind of pets are not allowed in the house.

 

PHOTOS

Gaia House is using from time to time photos she takes of her guests in social media and her website for promotions. If you don’t wish that your photo/s will be used for such, please make sure to note it to the management upon your arrival.   You grant us a non-exclusive, worldwide, perpetual, royalty free, irrevocable right to exercise all copyright and publicity rights with respect to the Multimedia Content and to use such Multimedia Content for the purpose of advertising and publicizing Gaia House products and services and you grant us a non-exclusive, worldwide, perpetual, royalty free, irrevocable right to use the Personal Content for the purpose of providing Services.

 

LIABILITY/YOUR HEALTH

Retreat participation, yoga, meditation, workshop, excursions, trips and exercise classes are undertaken at your own risk. All guests will be asked to complete and sign a medical questionnaire before attending the retreat/seminar to confirm you are sufficiently fit and healthy to take part in any classes/event/seminar/retreat and other physical activities.

 

If you have any health conditions you will need to inform GAIA HOUSE of these. We may ask you to provide a consent form from your doctor to confirm you can take part in physical activities. GAIA HOUSE will be blameless for any injuries incurred during your stay.

 

In no event shall we or our third-party service providers be liable to you or any other registered user for any special, indirect, consequential, incidental or punitive damages pursuant to this agreement, including but not limited to, loss of profits, loss of business opportunities or loss of goodwill, even if advised of the possibility of such damages.

 

WARRANTY DISCLAIMER

THE SERVICES PROVIDED BY GAIA HOUSE  OR OUR THIRD-PARTY SERVICE PROVIDERS ARE PROVIDED “AS IS,” AS AVAILABLE, AND WITHOUT ANY WARRANTIES OR CONDITIONS (EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OR TRADE). WE MAKE NO REPRESENTATIONS OR WARRANTIES, OF ANY KIND, EITHER EXPRESS OR IMPLIED, AS TO THE QUALITY, IDENTITY OR RELIABILITY OF ANY THIRD PARTY, OR AS TO THE ACCURACY OF THE POSTINGS MADE ON THE WEBSITE BY ANY THIRD PARTY. SOME STATES AND JURISDICTIONS DO NOT ALLOW FOR ALL THE FOREGOING LIMITATIONS ON IMPLIED WARRANTIES, SO TO THAT EXTENT, IF ANY, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

 

LOST AND FOUND ITEMS

Items left at the house will be returned only upon request and at the guests’ expense. GAIA HOUSE is not liable for lost items. GAIA HOUSE will only hold items for 45 days before they are waste.

 

WEATHER CONDITIONS

GAIA HOUSE cannot be made liable for unpleasant or unsuitable weather conditions therefore; no refunds are made in such occurrences.

 

FORCE MAJEURE

Gaia House shall not be responsible for the failure to perform or any delay in performance of any obligation hereunder due to labor disturbances, accidents, fires, floods, telecommunications or Internet failures, strikes, wars, riots, rebellions, blockades, acts of government, governmental requirements and regulations or restrictions imposed by law or any other similar conditions beyond the reasonable control of such party. The time for performance of such party shall be extended by the period of such delay. In the event of any the above, refunds and compensation payments cannot be made.

 

VERBAL CHANGES

Verbal changes of contract are not valid unless agreed and confirmed in writing by GAIA HOUSE.  All notices required or permitted to be given under these Terms of Service, shall be in writing and shall be deemed to have been duly given if delivered personally or sent by pre-paid telex, telefax or telegram, or mailed first-class, postage pre-paid, by registered or certified mail (notices sent by telex or telefax, or telegram, shall be deemed to have been given on the date sent; those mailed shall be deemed to have been given ten (10) business days after mailing) to the addresses set forth below or to such other address as any party shall designate by notice in writing.

ACCURACY OF CONTENT

While Gaia House uses its best efforts for the information contained on our site to be as accurate and reliable as possible, errors may sometimes occur. Gaia House reserves the right to revise the information contained on this site and to make such changes without notice to past or present users of our site. Links to Other Sites To this extent that this site may now or in the future include links, facts, opinions or recommendations of different individuals or organizations, Gaia House does not guarantee the accuracy or completeness or otherwise endorse these links, facts, opinions and recommendations.

 

GAIA HOUSE reserve the right to correct any printing or typing errors, lapses or calculation mistakes at any time. We also reserve the right to modify our Terms and Conditions that apply to your booking at any time and without prior notice.

 

REVISIONS TO TERMS AND CONDITIONS

Gaia House reserves the right to revise the terms and conditions contained on this site without any obligation to notify past, current or prospective visitors to our site. We request that you visit this site from time to time to review the current terms and conditions.

 

SEVERABILITY

If any part of these Terms of Service is held to be unenforceable, the unenforceable part will be given effect to the greatest extent possible and the remainder will remain in full force and effect.

 

GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the law of Germany and you hereby submit to the exclusive jurisdiction of the Courts in Germany.

 

COMPLAINTS AND SUGGESTIONS

GAIA HOUSE is confident that you will not have any reason for concern during your holidays/retreat/seminar. Nevertheless, if you would have any problems during your stay, please bring it to the attention of the house management.

 

If you are still not satisfied with the proposed resolution, then any further comments or proposals should be put in writing within 14 days of your return, specifying the problems to: anatagaia@gmail.com.
